Duo Rescued from Detention over Anti-Cab-3 Protest

A ZIMBABWEAN court has set free two Karoi residents, who had been arrested and detained for allegedly protesting and campaigning against the proposed amendment of the Constitution.

The two residents, Sabatine Tendaupenyu and Albert Magunje, were arrested on 27 June 2026 by Zimbabwe Republic Police (ZRP) officers, who charged them with incitement to commit public violence as defined in Section 187 as read with Section 36 of the Criminal Law (Codification and Reform) Act.

Prosecutors alleged that on 21 June 2026, Tendaupenyu and Magunje, connived and went to Mahororo Business Centre in Magunje in Mashonaland West province, where they allegedly dropped posters inscribed “Dump CAB-3” and posted some on trees.

The prosecutors charged that Tendaupenyu was seen wearing a T-shirt inscribed “No to CAB – 3 and also led ZRP officers to his homestead, where two white and purple-coloured T-shirts prescribed “Stop CAB – 3” were allegedly recovered in his bedroom.

In the case of Magunje, prosecutors charged that he led ZRP officers to his homestead, where a sack containing 102 flyers, 135 posters and two white and purple-coloured T-shirts all inscribed “No to CAB – 3” located under his bed in the bedroom were recovered.

On 1 July 2026, Tendaupenyu and Magunje were set free after their lawyers Tinashe Chinopfukutwa and Kelvin Kabaya of Zimbabwe Lawyers for Human Rights, applied for them to be released from prison on bail.

Tendaupenyu and Magunje were ordered to pay US$100 as bail money and to report once every week on Friday at ZRP Magunje Police Station and not to interfere with state witnesses in addition to continuing to residing at their given residential addresses.
