Komichi Trial Put on Hold as He Demands V11 Forms

THE trial of Morgan Komichi, one of the MDC-Alliance leaders has been put on hold after his lawyer requested the National Prosecuting Authority (NPA) to furnish him with some election materials, which the opposition political party is disputing its authenticity.

Komichi’s trial on charges of contravening the country’s electoral laws was supposed to commence on Thursday 18 October 2018 before Harare Magistrate Elisha Singano.

But Komichi’s lawyer Obey Shava of Zimbabwe Lawyers for Human Rights filed an application seeking an order to be furnished with further particulars before the commencement of the trial.

In his application, Shava asked the NPA represented by prosecutor Michael Reza to furnish his client with some election materials known as V11 forms containing results for nine constituencies, which Komichi allegedly disputed as the Zimbabwe Electoral Commission (ZEC) announced results for the 2018 presidential elections.

Shava also demanded to be furnished with the minutes of a meeting held between ZEC acting chief elections officer Utoile Silaigwana and chief election agents from various political parties, where verification procedures for the election results were agreed upon.

Magistrate Singano ordered Komichi to file his written submissions on his application by 25 October 2018 and the NPA to file its response by 30 October 2018 before handing down his ruling on 01 November 2018.

Komichi, the MDC Alliance party’s National Chairperson, was arrested on 17 August 2018 and charged with contravening section 186 of the Electoral Act after he allegedly interrupted, obstructed and disturbed proceedings of the announcement of the results of the 2018 harmonised elections on Thursday 02 August 2018 at the ZEC Command Centre in Harare by getting on the podium reserved for ZEC commissioners after the announcement break and announced his rejection of official results announced by the elections management body.
